Q. I have protected my tenants deposit but I forgot to give them the How to Rent booklet. Can my tenants sue me?

A. No, your tenant cannot sue you for failing to provide the governments ‘How to Rent’ booklet. The penalty for failing to serve this is that you cannot serve a section 21 notice on them, until such time as it has been served.

You may be a bit confused as the legislation unhelpfully describes the How to Rent booklet as ‘prescribed information’. But it is not at all the same as the tenancy deposit prescribed information (where failure to serve does mean that they can sue you for a penalty) and different rules apply.


Q. I have heard that only four people can legally be tenants. What does this mean for my tenancy where I had six tenants?
